Return and Refund Policy
Return, Refund, and Warranty Policy for Sunscape Solar Ltd
This Return, Refund, and Warranty Policy (the "Policy") is established to provide clarity and transparency regarding the terms and conditions applicable to the purchase of solar products from Sunscape Solar Ltd (the "Company"). By purchasing any product from the Company, the buyer ("Customer") acknowledges and agrees to the terms outlined in this Policy.
1. Returns and Exchanges
1.1. No Returns or Exchanges: The Company does not accept returns or exchanges on any products that are not damaged or defective upon receipt. All sales are final once the Customer has inspected and accepted the product.
1.2. Customer’s Duty of Inspection: The Customer is required to inspect the product immediately upon receipt to verify that it is in good working condition and free from any visible defects or damage. Any claims regarding defects or damages must be reported to the Company within 48 hours of delivery. Failure to notify the Company within this timeframe shall constitute acceptance of the product as-is.
1.3. Exclusions: The Company shall not accept returns, exchanges, or refunds for issues resulting from the Customer’s actions, negligence, misuse, improper installation, accidents, or failure to follow the product’s operating instructions.
2. Refund Policy
2.1. Refunds are not offered for products purchased from the Company unless the product is deemed defective or damaged during transit and reported within the specified timeframe. Refunds will only be processed after the Company has verified the defect or damage and confirmed that it occurred prior to delivery to the Customer.
2.2. The Customer is responsible for providing all relevant evidence, including but not limited to photographs, videos, and written descriptions of the damage or defect.
2.3. The Company reserves the right to repair or replace defective products at its sole discretion instead of issuing a refund.
3. Warranty Terms
3.1. Product Warranty: The Company offers a limited warranty on its products for a specified period as stated in the product documentation or invoice (the "Warranty Period"). This warranty covers manufacturing defects and failures arising from normal use in accordance with the product's guidelines.
3.2. Exclusions from Warranty: The warranty does not cover:
- Damage caused by improper installation, misuse, mishandling, or unauthorized repairs.
- Issues resulting from the Customer’s negligence, accidents, or failure to adhere to the product’s usage and maintenance instructions.
- Natural wear and tear, cosmetic damage, or damage caused by external factors such as power surges, natural disasters, or environmental conditions.
3.3. Warranty Claims: To initiate a warranty claim, the Customer must provide proof of purchase, a detailed description of the defect, and supporting evidence (e.g., photographs or videos). The Company reserves the right to inspect the product before approving or denying the warranty claim.
3.4. Remedies Under Warranty: If a product is determined to be defective under the warranty, the Company will, at its sole discretion, repair or replace the defective product. The Customer agrees that repair or replacement shall be the sole remedy under this warranty, and no refunds will be issued.
4. Limitation of Liability
4.1. The Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use the product.
4.2. The Customer assumes all risks associated with the installation, use, and maintenance of the product. The Company’s liability shall be limited to the purchase price of the product in question.
5. Dispute Resolution
5.1. Any disputes arising out of or relating to this Policy shall be resolved through amicable negotiations. If such negotiations fail, disputes shall be subject to arbitration in accordance with the applicable laws of Kenya.
6. Governing Law
6.1. This Policy shall be governed by and construed in accordance with the laws of [Your Jurisdiction].
7. Acceptance of Terms
